Terms of Service

These Terms of Service (“Terms”) are an agreement between you and TeleSafeguard, Inc. (“TeleSafeguard,” “we,” “us”). They cover your use of our check-in call service and this website. Please read them — especially the section on what this service is not.

1. Accepting these terms

By creating an account, subscribing, or using the service, you agree to these Terms. If you do not agree, please do not use the service.

You must be at least 18 years old and legally able to enter into a contract. If you are agreeing on behalf of a company or organization, you confirm you have authority to bind it.

2. What the service does

TeleSafeguard places AI-powered wellness check-in phone calls to a person you enroll (the “enrolled person”) — usually an aging parent or loved one. Our AI assistant, Grace, has a short conversation with them, typically about how they are feeling, sleep, mood, medications, and pain.

3. This is not a medical or emergency service

Please read this section carefully. It describes real limits of the service.

4. Authority and consent to enroll someone

When you enroll someone, you represent and warrant that you have the authority and that person’s consent to:

The enrolled person can withdraw consent at any time — by telling Grace on a call, or by contacting us at support@telesafeguard.com. When they do, we stop calling. We may also stop calls and close an account if we believe someone was enrolled without their consent.

5. Call recording and consent to be recorded

Check-in calls are recorded and transcribed. That is how we produce the summaries and alerts we send you. See our Privacy Policy for how those recordings and transcripts are stored, used, and deleted.

Recording laws vary by state. Some U.S. states require every party on a call to consent to being recorded. Because we do not have a direct relationship with the enrolled person, you are responsible for making sure they know the calls are recorded and transcribed, and that they agree to it, before the first call.

We capture your attestation of authority and consent when you sign up, and we record the date and IP address of that attestation.

6. Keeping your account accurate

You are responsible for keeping your account details current — your phone number, your email address, the enrolled person’s phone number, and your family contacts. The service cannot work with a wrong number. If a number changes and you do not update it, calls will fail and you may not be alerted. Keep your login credentials secure; you are responsible for activity under your account.

7. Subscriptions, billing, and cancellation

Every plan has a weekly rate. The plans and their exact call counts are:

The weekly rate for each plan is shown on our pricing page. You choose the time of day for your plan’s calls, in the enrolled person’s own timezone. Prices are in U.S. dollars and do not include any taxes that may apply.

Billing blocks. You pay for your plan in a block of your choice — 4 weeks, 3 months (12 weeks), 6 months (26 weeks), or 1 year (52 weeks). Your payment method is charged the weekly rate times the block length, once per block.

No calls on Sundays. On every plan, Grace calls Monday through Saturday only. Sunday is left clear by design, so the family makes that call themselves. A plan described as “daily” or “twice a day” means Monday through Saturday.

Auto-renewal. Subscriptions renew automatically at the end of each block — the same block length, charged again to your payment method — until you cancel. Payments are processed by Stripe.

Cancelling and refunds. You can cancel at any time from your billing portal or by emailing support@telesafeguard.com. When you cancel, we refund every whole week you paid for and haven’t used, at the weekly rate you paid. Calls continue to the end of the week in progress. For example, on a 26-week block of Advanced at $9.99 a week, cancelling after 8 weeks refunds the remaining 18 weeks — $179.82. Refunds go back to your original payment method, usually within 5 to 10 business days. We don’t ask for a reason.

Price changes. We may change prices. If we do, we will give existing subscribers advance notice by email, and your current price stays in place until that notice takes effect. If you do not want the new price, you can cancel before it applies.

Failed payments. If a payment fails and is not resolved, we may suspend the account. Suspension means calls stop. We will email you before that happens.

9. Availability

We work hard to place every scheduled call, but we do not guarantee uptime or that any particular call will be placed, connected, or completed. The service depends on telephony carriers, third-party AI voice providers, and hosting infrastructure we do not control. There will be planned maintenance and unplanned interruptions. We may change, suspend, or discontinue features over time.

10. Third-party services

Payments are processed by Stripe. Voice, telephony, and AI conversation are provided by our vendors. Those providers’ own terms and privacy policies govern their portion of the service. We are not responsible for their acts, omissions, or outages.

11. Privacy

Our Privacy Policy explains what we collect, how we use it, and how call recordings, transcripts, and summaries are handled. It is part of these Terms.

12. Intellectual property

The service — including the TeleSafeguard name and logo, the website, Grace’s design and conversation, and the software behind them — belongs to us and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service while your subscription is active. You keep ownership of the information you provide to us; you grant us the right to use it to operate and improve the service as described in our Privacy Policy.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT ANY CALL WILL BE PLACED OR COMPLETED, OR THAT ANY SUMMARY, ALERT, OR CONCERN DETECTION WILL BE ACCURATE OR COMPLETE.

14. Limitation of liability

To the fullest extent permitted by law, TeleSafeguard is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or damages for personal injury, emotional distress, or wrongful death arising from a missed, delayed, or failed call, an inaccurate summary, or a concern we did not flag.

Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless TeleSafeguard and its officers, employees, and contractors from claims, damages, and reasonable legal costs arising from your use of the service, your breach of these Terms, or your enrollment of someone without the authority or consent described in sections 4 and 5.

16. Changes to these terms

We may update these Terms. If the changes are material, we will update the date at the top and notify account holders by email before they take effect. Continuing to use the service after that means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in the State of Georgia. You and TeleSafeguard each consent to the personal jurisdiction and venue of those courts.
